PUBLIC UTILITY EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar($1.00) and other valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the Grantor,
Hickory Park, Inc. an Iowa Corporation, does hereby grant and convey to the Grantee, THE
CITY OF AMES, IOWA, perpetual easement and right-of-way in, over, upon, through, and
under the following described premises:
A 20' Permanent Easement: A strip of land 20.0' in width across the east one-half of the
Southwest Quarter of Section 12, Township 83 North, Range 24 West of the 5`h P.M. City of
Ames, Story County, Iowa being situated 10.0 feet on each side of the following described
centerline:beginning at a point on the North right of way line South 16th Street which is 50.0
feet N001 24' 56"W and 356.90 feet S89°39'17"E of the Southwest corner of the Southeast
Quarter of the southwest Quarter of said Section 12: Thence N26°36'03"E, 139.84 feet: thence
NO2°58'11"E, 240.28 feet: thence N00°03'53"W, 2204.00 feet to the point on the North line of
the Southwest Quarter of said Section 12 and there terminating. Containing 1.19 acres.
as shown on the attached Amended Easement Plat, only for the purpose of, to locate, relocate,
replace, construct, reconstruct, repair, operate, maintain, patrol and/or remove a water
line in, on, through, over, under and across the described land. For the purposes
aforesaid, the Grantee, its officers, employees, agents, licensees, successors, and assigns shall at
all times have the right and privilege of access to the above described premises.
The foregoing rights are granted upon the express condition that the users of the granted
rights will assume liability for all damage to the real estate described herein and any adjacent real
estate caused by failure to use due care in the exercise of the granted rights.
These grants of easement and right of way shall be binding upon the heirs, successors,
and assigns of the Grantor.
