CITY OF AMES
ACCESS EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, the City of Ames, Iowa, has utility poles, lines and appurtenances that
lie east of the property of Chamberlain, L.L.C.; and,
WHEREAS, the City desires to have the ability to go onto the East Twenty-five
(25) feet of Chamberlain, L.L.C.'s property to have access for the purpose of maintaining
said utility poles, lines and appurtenances.
THEREFORE, Chamberlain, L.L.C., its successors and assigns, does hereby grant,
bargain and convey to the City of Ames, Iowa, a municipal corporation, an access
easement, with the right, privilege and authority to said municipal corporation, its
successors, licensees, assigns and lessees, to enter upon the following described parcel of
land to maintain its utility lines, poles and appurtenances that are located east of and off
the following described land in the County of Story, State of Iowa:
Description:
The East Twenty-five-(25) feet of Parcel D in Block 4 in the
Auditor's Plat of Blocks 3, 4 and 5 of Beardshear's Addition
and Walter's Subdivision in the Northeast Quarter of the
Northwest Quarter of Section 9, Township 83 North, Range
24 West of the 5th P.M., in the City of Ames, Story County,
Iowa.
(See attached plat marked and made a part hereof.)
The Grantor does not grant the City of Ames, its successors and assigns, the right,
privilege or authority to locate, place, construct, operate or maintain overhead or
underground line or lines, or lines of poles, any fixtures, structures or appurtenances, nor
to in any way change the existing ground or surface on the above-described property.
Grantor warrants that it has good title to the above-described premises and that
there are no encumbrances which will limit or interfere with the rights granted herein to
Grantee.
The Grantor, its tenants, heirs, successors and assigns shall have the right to use
and enjoy said premises fully, except for the access easement granted to the Grantee.
The foregoing access easement is granted upon the express condition that the City
of Ames, Iowa, will assume all liability for all damages to the above-described property
caused by the City's use of the access easement granted herein.

authority of its Managers and the said Duane E. Jensen and Dean W. Jensen
acknowledged the execution of said instrument to be the voluntary act and deed of said
Chamberlain, L.L.C. by it voluntarily executed.
