WATER MAIN EASEMENT
KNQW ALL PERSON BY THIS INSTRUMENT that CYCLONE CENTER L.L.C., hereinafter
referred to as "Grantor", does hereby grant and convey unto the CITY OF AMES, IOWA, a municipal
corporation,hereinafter referred to as"City", the perpetual right to the following described easement:
A. Water Main Easement. Grantor grants to the City, and its agents, the•right to const ct,

reconstruct, .maintain, repair, test and use the water main and hydrant or ,
underground, over or across the following described real estate, al any part thereof, upon
within
Iowa:
l Lot Link Subdivision,Ames,
A 10' wide area of land centered on a line that coincides with the axis of an 8"water
main located in Lot 1 of Link Subdivision,Ames, Story County,Iowa in the NWt/4 of
the-NWt/4 of Section 14, Township 83 North, Range 24 West, more particularly
described as follows: Commencing at the southwest corner of said Lot 1; thence
along the east right-of-way line of Kellogg Avenue, N0010124"W a distance of
110.32'to the Point of Beginning; thence south 90°00100"east a distance.of 68.00,to
the point of terminus located 5' beyond the center of the fire hydrant, said area
containing 0.02 acres. See also attached Exhibit A.
B. General Terms and Conditions. Grantor, its successors and assigns,shall not:
1. erect any structures over or within the easement area without obtaining the prior written
approval of the City Engineer.
2. erect or cause to be placed on the easement area any structure, material device, thing or
matter which could possibly obstruct or impede the easement area without obtaining the
prior written approval of the City Engineer.
3. change-grade, elevation or contour of any part of the easement area without obtaining the
prior written approval of the City Engineer.
C. The City shall have the right of access to the easement area granted in the Easement together
with rights of ingress and egress reasonably necessary to the use and enjoyment of the easement area for the
Purposes described,including,but not limited to:
1. -the right to remove any unauthorized obstructions or structures placed or erected on the
easement area, and
2. the right to improve,repair and maintain the easement area.
D. Easement runs with the land. This easement shall be deemed to run with the land and sha
be binding on Grantors and on Grantors' successors and assigns. it
E. The foregoing rights are granted upon the express condition that users-of the granted rights will
assume liability for all damages to the hereinbefore described real estate and adjoining real estate caused by
failure to use due care in the exercise of the granted rights.
