HomeMy WebLinkAboutA001 - Council Action Form dated June 13, 2006 ITEM # li; 1. �%(��, fi��1 DATE 06/13/06 COUNCIL ACTION FORM SUBJECT: CROSS ACCESS EASEMENT FOR A SHARED DRIVEWAY FOR PROPOSED PARCELS "H" AND "J" AT 3514 LINCOLN WAY BACKGROUND: The owner of property at 3514 Lincoln Way proposes to divide the property into two parcels (Parcel "H" and Parcel "J"). (See attached Plat of Survey and Location Map.) Section 23.401(3)(c) requires that each lot (parcel of land) be provided with access to a public way. To assure that proposed Parcels "H" and "J" have permanent access to Lincoln Way, it is necessary that a "Cross Access Easement" be approved by the City Council, agreed to by the owners of Parcels "H" and "J", and filed with the Story County Recorder's Office. Recording of the Plat of Survey, dividing the land into two parcels cannot occur without approval of the "Cross Access Easement." The City Attorney's Office has reviewed the legal document establishing the "Cross Access Easement" (see attached) and has determined that it satisfies the City's requirements to assure permanent access to Parcels "H" and "J", as proposed by the Plat of Survey creating the two new parcels. ALTERNATIVES: 1. The City Council can approve the "Cross Access Easement" for the property at 3514 Lincoln Way (proposed Parcels "H" and "J"). 2. The City Council can deny approval of the "Cross Access Easement" for the property at 3514 Lincoln Way (proposed Parcels "H" and "J"). MANAGER'S RECOMMENDED ACTION: Approval of the Cross Access Easement for Parcels "H" and "J" will assure permanent access to a public street for both Parcels "H" and "J", and will enable recording of the Plat of Survey.
