HomeMy WebLinkAboutA001 - Council Action Form dated August 9, 2005 r Item # 1.3 Date: August 9, 2005 COUNCIL ACTION FORM SUBJECT: APPROVAL OF TEMPORARY EASEMENT AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPORTATION BACKGROUND: The Iowa Department of Transportation (IDOT) is in the process of developing a project to widen U.S. 69 (Grand Avenue) from Dawes Drive to 190th Street (Moose Road). The project will provide turn lanes at the intersections of public roadways and at the entrance into Ada Hayden Heritage Park. The City has entered into an agreement with the IDOT to provide funding of $200,000 towards this project, as shown in the 2005/06 Capital Improvements Plan. The widening construction will require extending the roadway foreslope into the park through a small portion of the northeast corner of the park property. This will not impact any of the improvements that were made with the development of Ada Hayden Heritage Park. The IDOT has submitted a temporary easement to facilitate the shaping of the new foreslope. An appraisal has been completed by the IDOT, setting the fair market value for this easement at $200. ALTERNATIVES: 1. Approve the temporary easement agreement with the Iowa Department of Transportation and waive the $200 easement payment. 2. Approve the temporary easement agreement, asking for the appraised cost, with the Iowa Department of Transportation. 3. Reject the temporary easement agreement. MANAGER'S RECOMMENDED ACTION: The impacts to the park property will be minimal. The easement is temporary and will not affect the property lines. Rejecting this easement will likely lead the IDOT to pursue condemnation. In an effort to maintain the good will and cooperative relationships that have been developed with the IDOT, staff is recommending providing the temporary easement and waiving the $200 payment from the IDOT. It is the recommendation of the City Manager that the City Council adopt Alternative No. 1, thereby approving the temporary easement agreement with the Iowa Department of Transportation and waiving the $200 easement payment.
