WATER MAIN EASEMENT
KNOW ALL PERSONS BY THIS INSTRUMENT that the Lutheran Services in Iowa, Inc.,its
successors and assigns, in consideration of the sum of one dollar ($1.00) and other good and valuable
consideration, receipt of which is hereby acknowledged, does hereby grant to the City of Ames, Iowa, a
Municipal Corporation,its successors and assigns,the perpetual right to construct,maintain,repair and use
water main and apparatus and other public facilities upon, underground, over and across the following
described real estate:
Commencing at the SE Corner of the SW'/4 of the SE'/4 of Section 34,T84N,R24W,of the
5'P.M., in the city of Ames, Story County, Iowa; thence westerly along the south line of
said Section a distance of 165; thence northerly a distance of 33' to a point on the north
ROW of 13'Street,said point also being on the west ROW ofNorthwestern Avenue;thence
northerly along the west ROW of Northwestern Avenue a distance of 238'to the point of
beginning;thence westerly 5';thence northerly 5'along a line parallel to said ROW;thence
easterly 5' to a point on said ROE; thence south 5' along said ROW line to the point of
beginning
all as shown on the attached plat.
The Grantor also grants to the Grantee the right of ingress and egress to said water main over
adjoining lands now owned by the Grantor, for the purpose of constructing, reconstructing, maintaining,
operating and repairing said water main.The stated rights are granted on the express condition that users of
the granted right will assume liability for all damages to the described real estate and adjoining real estate
caused by failure to use due care in the exercise of the granted rights.
