HomeMy WebLinkAboutA001 - Temporary Construction Easement - Sigler Printing PARCEL NO. 10 AMES, STORY COUNTY, IOWA U.S. 69 - SOUTH DUFF AVENUE WIDENING IMPROVEMENT PROJECT TEMPORARY CONSTRUCTION EASEMENT KNOW ALL THESE MEN BY THESE PRESENTS: In consideration of one dollar and other good and valuable consideration in hand paid by the City of Ames, Grantee, receipt of which is hereby acknowledge, _Ronald J. McMillen (owner) and Sigler Printing (tenant), Grantors, their heirs, successor and assigns, do hereby grant to the City of Ames, Iowa, a municipal corporation, in the County of Story, State of Iowa, a temporary construction easement under, through and across the following described real estate: SEE ATTACHED EXHIBIT "A" FOR TEMPORARY CONSTRUCTION EASEMENT Except for any existing buildings or permanent improvements within the easement unless specifically identified for removals. That said temporary construction easement is granted unto the City of Ames, Iowa, for the purpose of street and accessway grading, shaping, paving, pavement marking and backsloping,utility and drainage construction and off-site reconstruction activities associated with the U.S. 69 - South Duff Avenue Widening Improvement Project. The temporary easement shall be in existence during the construction of the U.S. 69 - South Duff Avenue Widening Improvement Project, but not thereafter. The said City of Ames shall restore said described property to a satisfactory condition after the temporary easement is no longer required for its purpose, in substantially the same condition as prior to entry, except as may be shown on the U.S. 69 - South Duff Avenue Widening Improvement Project drawings. The City will also insure access to the property during established business hours. WP\LTR76\WA71GZTBM i TEMPORARY CONSTRUCTION EASEMENT That the Grantor does hereby covenant with the said Grantee, and successor-in- interest, that said Grantor holds said real estate by title and fee simple; that it has good and lawful authority to sell and convey the same; that said premises are free and clear of all liens and encumbrances whatsoever, except as may be herein stated; that said Grantor covenants to warrant and defend the said premises against the lawful claims of all persons whomsoever, except as may be herein stated. Also in consideration of said payment by the City, Grantors, their heirs, successors and assign hereby release the City of Ames from any damages that may be claimed for any permanent or temporary changes in street grade or changes in or loss of vehicular access from South Duff Avenue due to the U.S. 69 - South Duff Avenue Widening Improvement Project.
