MATTERS FOR THE ESTABLISHMENT
OF A PUBLIC PARKING LOT
THIS AGREEMENT,made and entered into a$of the day of July, 1997,
by and between THE CITY OF AMES, IOWA (44MO)"ptr milled the City), and EDWARD
J_ WEDELSTEDT, his heirs, successors and assigns. (hereinafter called Developer),
WITNESSES THAT :
WHEREAS, the City is the of a tax sale deed recorded at Book 204, P

Lot 11,Leo and Munn's Subdivision of Lot A,Block 49, Fourth Addition to the

City of Ames, Iowa;
and,

WHEREEAS,the Developer Is the holder of a Warranty Dead recorded as Instrument
No, $6-13041 in the office of the Story County Recorder fat land described as:

and,

MOW,'THEREFORE,the parties hereto agree as follows:
a� i. The Developer shall,at Its sole expense, construct the unproved parking lot
on the above described land in accordance with the site plan and specification attached
hereto as Exhibit A.

2, The City shall install and operate, at Its sole expense, a parking meter with
respect to each of nine parking spaces, six of which metered parking spaces shall be on
the said lot eleven, and three of the metered spaces shall be divided between lot eleven
and lot twelve. it is anticipated that the metered rate For parking shall be set at 20 cents
per hour, and that the time allowed to parK in a space skull be limited to two hours, but It
is understood that the City may change the parking rates and regulations from tjlne to Ume
as a matter of its governmental discretion.
3. The Developer shall, at its solar expense, maintain the said parking lots, to
Include snow and ice removal, to the same standards the City applies to the Central
Business District parking lot.
4. The City shall, at Its sole expense, enforce..the-parking-meter,rates"anif,r
parking time limits to the same standards of enforcement as are applied to the Central
Business District parking lot; and, the City shall receive and retain all parking meter
revenue,
6, Easements are hereby granted by Developer to the City and City to the
Developer with respect to Ingress and egress over and on the above described land for the
purpose of establishing, maintaining and operating a public parking lot: and, City and
Developer shall permit the general public to use the abets described land for the parking
of motor vehicles without Interference, but subject to the regulations that the City may
establish From time to time with respect to the said parking of motor vehicles.
6. Either party to tttis ag+"Ment-may terminate this agreement on 180 days
written notice to the other party.
