Klaus, City Attorney DATE: November 9, 2001 SUBJECT: Stone Brooke Association, Request for Path Easement At the Council's meeting of October 23, the attached October 1 request from Stone Brooke Association for a paved path easement was referred to staff. With this is a proposed easement agreement between the City and the Stone Brook Association. If it is acceptable to you, let me know and I will send it to the Stone Brooke Association. The Stone Brooke Association requests an easement on a portion of this property so the developers can complete the paved path as originally scheduled. �,,� The easement being requested is that area in4U on the enclosed map. If the easement is granted the path could then be completed throughout Stone Brooke, thereby satisfying a Planning and Zoning requirement that this path be installed throughout the development when it was approved as a PUD. A twenty-foot easement from the back of the residences' property lines and on the area which adjoins Stone Brooke Road which is owned by the City would allow a path with grass planted on each side to make it an attractive addition.
