The undersigned grantors, Corwin V. Stephan and Kaye M. Stephan,
do hereby grant and convey to the Olive Branch Child Daycare Center,
Inc. , (hereinafter known as "daycare center"), an Iowa corporation,
their successors and assigns, and the City of Ames, Iowa, a municipal
corporation, the right, title and easement to park or direct and permit
the parking of the personal automobiles of the persons who may from time
to time be employees of the daycare center and invitees thereof, of the
property located at 2312 Edison, Ames, Iowa, on the following described
real estate locally known as 2222 Edison, Ames, situated in Story
County, Iowa, to wit:
Lot 2 of Block 3, Landfill Addition, Story County, Iowa
Five parking spaces meeting all the requirements of the Ames
Municipal Code shall be provided by grantors, and the grantors shall
maintain the said spaces and access routes to and from the spaces in a
passable and usable condition, clear of snow accumulations, ponded
water, brush, weeds or other conditions that could impede or discourage
use of the spaces. Location of the parking spaces appears in the
attached Exhibit "A".
The foregoing shall be a covenant running with the land, binding on
the owners of the real estate described above, their successors and
assigns. If said rights and obligations are defeated, annulled or
undone through mortgage foreclosure, bankruptcy, or other event or
process and as long as a daycare center is operated at 2312 Edison,
Ames, Iowa, the grantors, their successors or assigns, shall be bound
hereby to the City of Ames, Iowa, to acquire and provide replacement
parking rights under similar terms at a site within 300 feet of the
building or buildings at 2312 Edison, Ames, Iowa.
The foregoing may be released by resolution of the City Council of
Ames, Iowa, if alternative arrangements for parking are made elsewhere
within 300 feet of the building or buildings at 2312 Edison, Ames, Iowa,
under terms acceptable to the Ames City Council .
The foregoing may also be released by resolution df the City
Council of the City of Ames, Iowa, if, due to changes in the ordinances
of the City of Ames, Iowa, the parking requirements for the building or
buildings at 2312 Edison, Ames, Iowa, are no longer necessary under the
ordinances of the City of Ames, Iowa.
