RESOLUTION OF NECESSITY FOR ACQUISITION OF PERMANENT AND
TEMPORARY EASEMENTS FOR IMPROVEMENTS TO THE INTERSECTION
OF LINCOLN WAY AND CLARKIWALNUT STREETS; AUTHORIZING THE
DIRECTOR OF PUBLIC WORKS TO ATTEMPT TO ACHIEVE AGREEMENT
ON COMPENSATION WITH PARTIES HAVING PROPERTY INTERESTS IN
THE SITE; AND DIRECTING THE CITY ATTORNEY TO INSTITUTE
EMINENT DOMAIN PROCEEDINGS

BE IT RESOLVED,by the City Council of the City of Ames, Iowa:
Section One. On the basis of traffic safety related engineering studies and reports done and made to the
Ames City Council by the City's engineers in consultation with the Iowa Department of Transportation,
it is hereby found and declared to be reasonable and necessary to the public safety, welfare and
convenience that permanent and temporary easements for street purposes be acquired as described and
shown on the plat attached hereto and by this reference made a part hereof.
Section Two. The permanent street easement is required on land described as:
The north thirteen feet(13')of the west thirteen feet(IT)of Lot 6,Block 4, Ames, Story
County, Iowa, containing 169 square feet,more or less.
The temporary construction easement is required over land described as:
The West 8 feet of the South 77 feet of the North 90 feet of Lot 6; and, except that portion
within the 13 foot by 13 foot square area in the northwest corner, a triangular piece with
sides 22 feet in length east and 30 feet in length south of a point 8 feet east of the
northwest corner of Lot 6, in Block 4 of Black's Addition to Ames, Story County, Iowa,
containing 881 square feet,more or less,
all as shown on the aforesaid attached plat.
Section Three. The Director of Public Works is authorized and directed to attempt to achieve an
agreement with the parties having property interests in the site of the required easements by making an
offer of compensation that is reasonable and consistent with the estimates and appraisals of just
compensation provided by expert and qualified real estate value appraisers.
Section Four. The City Attorney is hereby authorized and directed to institute and conduct eminent
domain proceedings, pursuant to Chapter 6A and 6B Code of Iowa, to acquire the above described
easements,unless and until instructed otherwise by the City Council.
