Proposed work is shown on the attached plat and cross sections,and further described as follows: Building a bike trail with 8 feet wide granular surface and placing a fence _ 15' both sides of trail from center between piers. Remove existing R.O.W. fence —_ for 30' on north and south R.O.W. lines. The proposed work is located in Sec. 15 Twp. 83N Range 24W on Highway No. US 30 0.4 Miles east from US 30/Elwood Drive interchange in Ames At Direction Place,Town,Etc. Show Station 1199+58.89 alumina ,00ft t1t! AGREEMENTS The applicant agrees that if granted a permit to do said work the following stipulations shall govern. 1. The applicant shall take all reasonable precautions during construction and future maintenance to protect and safeguard the lives and property of the traveling public and shall save the State and the Iowa Department of Transportation harmless of any damage or losses that may be sustained by the traveling public on account of such construction or maintenance operations. 2. The applicant shall hold the State and the Iowa Department of Transportation harmless of any damage that may result to said highway because of the construction or maintenance of the facility, and shall reimburse the State or the Iowa Department of Transportation for any expenditures that the State of Iowa or the Department of Transportation may have to make on said highway on account of said applicant's construction. 3. The applicant,and his contractors,shall carry on construction and maintenance with serious regard to the safety of the public. Traffic protection shall be in accordance with Part VI of the current Iowa Department of Transportation Manual on Uniform Traffic Control Devices for Streets and Highways.The Department will loan the required signs to the applicant who shall be responsible for placing the signs and covering or removing when not in use. Flagging operations are the responsibility of the applicant.The applicant shall return the signs upon completion of the construction operation. 4. The applicant shall seed and mulch all disturbed areas within the highway right of way and shall be responsible for the vegetative cover until it becomes well established.Any surfaced areas such as driveways or shoulders and sodded waterways and plantings which are disturbed shall be restored to their original condition. 5. if the proposed work results in a pool of water on the applicant's property,this pool of water will be exclusively owned,controlled, and maintained by the applicant. That part of the modification located on highway right of way will be maintained by the Iowa Department of Transportation for road purposes only. 6. The applicant shall maintain any drainage structure built within the right of way that is built for the benefit of the applicant and not necessary for highway use. 7. This permit is subject to any laws now in effector any laws which maybe hereafter enacted and all applicable rules and regulations of local, state and federal agencies. 8. This permit is subject to all the rules and regulations of the Iowa Department of Transportation,and to revocation by the Iowa Department of Transportation at any time and at no cost to the Department,when in the judgment of the Department it is necessary in the improvement or maintenance of the highway or for other reasonable cause. 9. The applicant agrees to give the Iowa Department of Transportation 48 hours notice of intention to start construction or perform maintenance on the highway right of way.Said notice shall be made in writing to the Resident Maintenance Engineer whose Pame and address is shown below. Any modifications to the proposed work shall be approved by the Department prior to making the change. 10. All proposed work covered by this permit shall be at the applicant's expense.The applicant shall reimburse the Iowa Department of Transportation for any materials removed from the highway right of way described as follows: None 11. No barbed wire will be required on new installations. All other requirements of Standard RC-8, shall apply. The applicant shall be responsible for any and all damages to the bridges or otner highway appurtenance arising out of the construction, maintenance and operation of the bike trail ana adjacent airspace ana snail be responsible for any and all damages to the puuiic for personal injury, loss of life and property damage arising out of the maintenance and operation of the airspace. The applicant snail idemnify and save harmless the DOT from all suits, actions, or claims of any character brouant because of any injuries or damages received or sustained by any person, versons, or property because of the maintenance ano operation of the airspace. e. The applicant shall maintain aceauate drainage through the drainage area next to the bike trail embankment. f. Should future maintenance be required to the bridge structure in the area of the hike trail , the Department of Transportation maintains the right to enter upon the bike trail area ana assumes no liability for possible damages incurred to the bike trail or fence. g. Authorization of this application does not assure continues passage of highway right of way, wr:erf ana if existing bridges neea to be replaceo or removed.
