RESOLUTION APPROVING EASEMENT AGREEMENT TO ASSURE
RETENTION OF SHARED OFF-STREET PARKING
PER SECTION 29.42(2) OF THE MUNICIPAL CODE
FOR THE CITY OF AMES, IOWA
WHEREAS, a retail establishment called"Ames Surplus" wants a zoning and building permit
to expand at its present location; and,
WHEREAS,that enlargement will necessitate an increase in the number of off-street parking
spaces needed to meet zoning regulations; and,
WHEREAS,the building lot is not large enough to accommodate both the enlarged building
and an increased number of parking spaces; and,
WHEREAS, Section 29.42 of the City zoning regulations allows the parking spaces required
for a change or enlargement of use on a site to be located on another site within 300 feet if there is
a written agreement that assures the retention of those spaces approved as to form by the City
Attorney; and,
WHEREAS, since the parties to any agreement may rescind the agreement, the only form of
agreement that can assure the City that the spaces will be retained is one to which the City is a party
or the grantee of an easement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Easement Agreement among Marvin Wayne Quinlan and Lola Frances Quinlan and PMD
Real Estate Partnership, as adjacent land owners, and the City of Ames, Iowa, pertaining to the
shared off-street parking at the retail establishment called"Ames Surplus" is hereby approved.
ADOPTED THIS 9th day of November, 1999.
