RIGHT OF WAY PERMIT AND EASEMENT
Erik Munn and Shelli R. Munn, Husband and Wife, in consideration of sum of
one dollar, the receipt of which is hereby acknowledged, grants to the City of Ames,
Iowa, a Municipal Corporation, its successors and assigns, including any public
designated by the City, the perpetual right to construct, reconstruct, repair, maintain,
and use underground electrical lines, telephone lines, wires, cables, and other
equipment on any part thereof for the purpose of conveying electrical current for
power and lighting purposes, and for communicative transmissions, on the real
estate described as follows:
The west 10' of Parcel "G" locally known as 901 Airport Road and
described as follows:
Parcel "G" in the Southeast Quarter of the Northeast Quarter of
Section 15, Township 83 North, Range 24 West of the 5t" P.M.,
Ames, Story County, Iowa. Further described as: Commencing at
the Southeast Corner of said SE'/4-NE'/4, Sec 15-83-24: thence
S89050'00"W, 664.55 ft. along the South Line of said SE1/4-NE'/4 to
the Point of Beginning; thence 89050'00"W, 414.50 ft. continuing
along said South Line; thence NO°06'45"W, 924.64 ft.to the Southerly
Right-of-Way Line of U.S. HWY#30; thence N84°46'55"E, 418.08 ft.
along said South R.O.W. Line; thence SO°13'05"W, 961.46 ft. to the
Point of Beginning.
The foregoing rights are granted upon the express consideration that the City
of Ames will assume liability for all damage to the hereinbefore described property
caused by said City's failure to use due care in its exercise of the granted rights.
