EASEMENT
KNOW ALL PERSONS BY THIS INSTRUMENT that Lincoln-Bell Investors, L.L.C., a
Delaware Limited Liability Company, does hereby grant its successor and assigns and the CITY
OF AMES,IOWA and its successors and assigns, the perpetual right to the following described
easements:
(1) Storm Water Detention Pond Easement. Grantor grants to the City of
Ames, Iowa, its successors and assigns, the right to use as a Storm Water Detention Pond, up to
Eight (8) acre feet of storage capacity in a parcel of land located across Lot One (1), Hach
Subdivision, Second Addition, Ames, Story County, Iowa more particularly described as
follows:
Commencing at the Southwest Corner of Lot 1 of Hach
Subdivision, Second Addition, thence N00°49'09"W, 99.26 feet to
the Point of Beginning, thence N00049'09"W, 595.15 feet, thence
N89°28'49"E, 394.95 feet, thence S00°48'31"E, 403.58 feet,
thence S89°16'42"W, 128.46 feet, thence S83°42'47"W, 128.50
feet, thence S60°08'44"W, 72.61, thence S00°49'09"E, 142.69
feet, thence S89°31'03"W, 75.00 feet to the Point of Beginning.
(2) Maintenance of Detention Pond. The City shall be responsible for the
maintenance of the shorelines, storm sewer outlets and emergency spillway for erosion only.
The grantor, As successors and assigns shall be responsible for the removal of trees within the
detention pond easement area and for all mowing and other landscape maintenance.
(3) Storm Sewer and Surface Flowage Easement. Grantor further grants to
the City of Ames, Iowa, its successors and assigns, the right to use, for surface water flow and
for storm sewer purposes, a parcel of land located across Lot One (1), Hach Subdivision, Second
Addition, Ames, Story County, Iowa more particularly described as follows:
Commencing at the Southwest Corner of Lot 1 of Hach
Subdivision, Second Addition, thence N00°49'09"W, 99.26 feet,
thence N89°31'03"E, 75.00 feet to the Point of Beginning, thence
N00049'09"W, 60.00 feet, thence N89°31'03"E, 319.85 feet,
thence S00°48'31"E, 40.00 feet, thence S89°31'03"W, 244.84
feet, thence S74033'51"W, 77.51 feet to the Point of Begining.
(4) Detention Pond Outlet Pipe Easement. Grantor further grants to the City of
Ames, Iowa, its successors and assigns, the right to use a parcel of land located across Lot One
(1),Hach Subdivision, Second Addition, Ames, Story County, Iowa more particularly described
as follows:
Commencing at the Southwest Corner of Lot 1 of Hach
Subdivision, Second Addition, thence N00°49'09"W, 99.26 feet,
thence N89°31'03"E, 75.00 feet, thence N00°49'09"W, 60.00 feet,
thence N89°31'03"E, 107.64 feet to the Point of Beginning, thence
N00°08'16"W, 122.94 feet, thence N83°42'47"E, 20.12 feet,
thence S00°08'16"E, 124.97 feet, thence S89°31'03"W, 20.00 feet
to the Point of Beginning.
(5) Access Easement. Grantor further grants to the City of Ames, Iowa, its
successors and assigns, the right of ingress and egress over and across Lot 1 of Hach
Subdivision, Second Addition, Ames, Story County, Iowa for the purpose of the exercise of its
other easements granted in this instrument.
(6) BindingE . This instrument, and the agreements contained in this
instrument shall inure to the benefit of and be binding and obligatory on the heirs, executors,
administrators, successors, and assigns of the Grantor and all Owners of the real estate.
