HomeMy WebLinkAboutA002 - Resolution No. 03-022 adopted January 14, 2003 1 M M RESOLUTION NO.03-022 RESOLUTION APPROVING ACQUISITION OF STORM SEWER EASEMENT ON LOT 1 OF HACH SUBDIVISION,2ND ADDITION FOR THE CITY OF AMES WHEREAS,the 2002/05 Capital Improvements Program(CIP)includes a project to improve drainage problems that occur upstream of the Pete Cooper Subdivision which is located south of Lincoln Way and west of Dayton Avenue;and, WHEREAS,this project(known as the Southeast 5'Street Storm Sewer Project)is the last phase of a two-part project; and, WHEREAS,the storm water retention structure also receives drainage from developed ground to the north and east of Pete Cooper Subdivision, and drainage that flows into this retention structure includes the Barilla site, the Ball Plastics Container site,Hach Chemical,and the Ames Community Development Park; and, WHEREAS,staff hired Fox Engineering of Ames,Iowa,to complete a drainage study for Phase II of this project,and the study focused on increasing storm water detention volume upstream of Pete Cooper Subdivision; and, WHEREAS, areas that were investigated were the Barilla location, the Ball Plastics Container site, and Hach Chemical; and, WHEREAS,from this study, it was determined that the most economical solution was to enlarge the Ball Plastics Container storm sewer and use its detention pond as an area-wide detention basin;and, WHEREAS,the detention basin constructed for the Ball Plastics Container warehouse expansion was placed on Lot 1,Hach Subdivision,2"Addition which is located east of Bell Avenue; and, WHEREAS,the grading for the detention basin created a volume that exceeds the City's needs for completing the Southeast 5'Street Storm Sewer Project and the needs of the Ball warehouse expansion project;and, WHEREAS,the developer has proposed that the City would purchase the storm water storage easement for the area- wide detention basin constructed on Lot 1 of Hach Subdivision,2nd Addition for$115,000;and, WHEREAS,staff has reviewed the proposal and feels that the compensation requested is fair consideration due to what it would cost to develop another detention basin in a different location;and, WHEREAS,funding for this project was$120,000 in G.O.Bonds of which$116,207 remains available to be spent for the project. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that the acquisition of a storm sewer easement on Lot 1,Hach Subdivision,Second Addition is hereby approved and payment of$115,000 is authorized to Panattoni Development Company for same. ADOPTED THIS 14"day of January,2003.
