COUNCIL ACTION FORM
SUBJECT: AUTHORIZING ACQUIRING STORM WATER STORAGE EASEMENT
ON LOT 1 HACH SUBDIVISION SECOND ADDITION, AMES, IOWA.
BACKGROUND:
The 2002/05 Capital Improvements program includes a project to improve drainage
problems that occur upstream of the Pete Cooper Subdivision which is located south of
Lincoln Way and west of Dayton Avenue. The project is called Southeast 5th Street
Storm Sewer. This project is the last phase of a two-part project. The first phase
provided an overflow outlet from the storm water retention structure located in the
Carney Auto Salvage lot at Southeast 5th Street and Freel Drive to the Skunk River.
Prior to that project, the retention structure, designed to control the increase in runoff
due to development in the Pete Cooper Subdivision, overflowed into the adjoining farm
fields south of the retention structure when the retention pond was full. Until a drainage
ditch from the Southeast 5th Street/Free[ Drive area to the Skunk River was constructed
in 1999/00, localized flooding also occurred in the Carney Auto Salvage lot.
The storm water retention structure also receives drainage from developed ground to
the north and east of the Pete Cooper Subdivision. The drainage that flows into this
retention structure includes the Barilla site, the Ball Container site, Hach Chemical and
the Ames Community Development Park.
Staff hired Fox Engineering of Ames, Iowa to complete the drainage study for Phase
Two of this project. Fox Engineering was also developing the warehouse expansion
plans for Ball Container at the same time. Staff felt that developing these projects jointly
would result in cost savings to both the City and to the developer of the Ball Container
site. The study focused on increasing storm water detention volume upstream of Pete
Cooper Subdivision. Areas that were investigated were the Barilla site, the Ball
Container site and the Hach Chemical site.
Fox Engineering investigated the costs of constructing storm sewer improvements and
detention ponds for the Southeast 5th Street Storm Sewer project. Fox Engineering also
investigated the costs of enlarging the storm sewer improvements and detention pond
for the Ball Container site to accommodate the drainage needs for both the Southeast
5th Street Storm Sewer project and Ball Container warehouse expansion project.
From this study, it was determined that the most economical solution was to enlarge the
Ball Container storm sewer and use the Ball Container detention pond as an area wide
detention basin for both projects. The detention basin constructed for the Ball Container
warehouse expansion was placed on Lot 1 of the Hach Subdivision Second Addition,
which is east of Bell Avenue. The additional soil required for the Ball Container
warehouse site on the east side of Bell Avenue came from the material that was
excavated from the detention basin. All of this grading created a volume in the

detention basin that exceeds the City's needs for completing the Southeast 5th Street
Storm Sewer project and the needs of the Ball warehouse expansion project. The
developer has proposed that the City would purchase the storm water storage
easement for the area wide detention basin constructed on Lot 1 of Hach Subdivision
Second Addition for $115,000. Staff has reviewed the proposal and feels that the
compensation requested is fair consideration due to what it would cost to develop
another detention basin in a different location. This project is an example of how the
City and a private developer can both benefit from joint involvement in meeting
individual needs.
Funding for this project was $120,000 in G.O. Bonds of which $116,207 remains
available to be spent for the project.
ALTERNATIVES:
1. Authorize payment of $115,000 to Panattoni Development Company for a storm
water storage easement on Lot 1 of Hach Subdivision Second Addition, Ames, Iowa.
2. Reject the easement and construct another detention basin in a different location.
MANAGERS RECOMMENDED ACTION:
It is the recommendation of the CityManager that the City Council authorize payment of
