RESOLUTION NO. 03-009
RESOLUTION APPROVING EASEMENT TO PARKLAND AT 3115 OAKLAND
(ADJACENT TO EMMA McCARTHY LEE PARK)
FOR THE CITY OF AMES
WHEREAS, in 1983, the City of Ames installed a footbridge across Clear Creek in Emma
McCarthy Lee Park in order to connect the Oakland Street access point to the Park on what was
presumed to be City property; and,
WHEREAS, portions of the pathway traversed across five small segments of privately
owned property, and staff immediately contacted the affected property owners and requested
Easements for Public Access through their properties;
WHEREAS,owners of one property,Alice and William Murray of 3207 Oakland,responded
and executed an agreement, which was approved in September 1985; and,
WHEREAS, the owners of the remaining four properties (3201, 3115, 3111, and 3109
Oakland)did not object to the City's utilization of their property for a pathway,but never responded
to the City's request to pursue an easement; and,
WHEREAS,in 1996, Christine and Gary Hunziker purchased the lot at 3111 Oakland and
requested an easement for their property, which the City Council approved in June 1996; and,
WHEREAS, in November 2002, Lucinda and Dirk Scholten contacted the City and
requested an easement for their property located at 3115 Oakland; and,
WHEREAS, no payment is being requested by the property owner for the easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Easement for Public Access to Parkland with Lucinda and Dirk Scholten of 3115 Oakland
is hereby approved.
