HomeMy WebLinkAboutA001 - Council Action Form dated January 14, 2003 ITEM # 100 DATE: January 14, 2003 COUNCIL ACTION FORM SUBJECT: EASEMENT FOR PUBLIC ACCESS TO EMMA MCCARTHY LEE PARK BACKGROUND: In 1983, the City of Ames installed a footbridge across Clear Creek in Emma McCarthy Lee Park in order to connect the Oakland Street access point to the park on what was presumed to be City property (Attachment A). Unfortunately, staff did not realize that portions of the pathway traversed across five (5) small segments of privately owned property. Once this was realized, staff immediately contacted the affected property owners and requested Easement for Public Access through their areas. Only one property owner, Alice and William Murray of 3207 Oakland, responded and executed an agreement that City Council approved in September 1985. The remaining four (4) property owners at 3201, 3115, 3111, and 3109 Oakland did not object to the City's utilization of their property for a pathway, but never responded to the City's request to pursue an easement. In 1996, Christine and Gary Hunziker purchased one of the four remaining lots at 3111 Oakland and they requested an easement for their property. The City Council approved an agreement in June 1996. In November 2002, Lucinda and Dirk Scholten contacted the City and requested an easement for their property located at 3115 Oakland. Staff will continue to work with the property owners of 3201 and 3109 to obtain easements on these remaining properties. ALTERNATIVES: 1. Approve the "Easement for Public Access to Parkland" with Lucinda and Dirk Scholten of 3115 Oakland, Ames, Iowa. 2. Do not approve the "Easement for Public Access to Parkland" with Lucinda and Dirk Scholten of 3115 Oakland, Ames, Iowa. CITY MANAGER'S RECOMMENDED ACTION: It is recommended by the City Manager that the City Council adopt Alternative #1 approving the "Easement for Public Access to Parkland" with Lucinda and Dirk Scholten of 3115 Oakland, Ames, Iowa.
