UTILITY EASEMENT
KNOW ALL PERSONS THAT BY THIS INSTRUMENT,that Panattoni Development
Co., its successors and assigns, does hereby grant to the City of Ames, Iowa the perpetual right to
construct, reconstruct, maintain and use electric lines, communication lines, and a sanitary sewer
main upon,underground,over and across the vacated portion of East Lincoln Way,Ames,Iowa,that
is shown and described on Exhibit A attached hereto. The City of Ames shall have the right of
access to the easement areas together with the right to remove any unauthorized obstructions or
structures placed or erected on the easement area.
The foregoing rights are granted upon the express condition that users of the granted rights
shall assume liability for damage caused by failure to use due care in exercise of the granted rights.
