HomeMy WebLinkAboutA001 - Council Action Form dated March 26, 2002 Item # 35 Date: March U. 2002 COUNCIL ACTION FORM SUBJECT: ESTABLISHING HEARING DATES FOR VACATION AND SALE OF EAST LINCOLN WAY RIGHT-OF-WAY WEST OF BELL AVENUE BACKGROUND: The developer of the property west of Bell Avenue and east of I — 35 just south of East Lincoln Way has requested that some of the East Lincoln Way right-of-way be vacated and sold to them. The attached letter details the request and the plat map shows the amount of right-of- way that would be transferred. The developers' intend to use the 0.56 acres of road right-of- way as side yard set back and maximize the building area on this site. The request indicated that the developer wanted to receive the right-of-way in exchange for the value the City would receive when the developer completed the storm water improvements and detention pond for the Panattoni Building expansion. The developer and staff have concluded that following the established City policy for disposing of right-of-way will not change the project's net cost to the developer and the developer is willing to purchase the right-of-way. According to City policy for disposing of City right-of-way, the adjusted value of this 0.56 acres of right-of-way is $25,613.28. This value is determined by taking the value of the adjacent property and as per City policy, deducting 10% for quit claim deed and deducting 15% for maintaining easements on the property. ALTERNATIVES: 1. Set April 9, 2002 as the date of public hearing on an ordinance to vacate the East Lincoln Way right-of-way between I — 35 and Bell Avenue. Staff also recommends that City Council approve a resolution proposing to sell the property to the developers of the Panattoni Building expansion for $25,613.28 and establish April 9, 2002 as the date of public hearing on the resolution to sell the property. 2. Do not vacate the East Lincoln Way right-of-way between I — 35 and Bell Avenue. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council accept alternate number one and set April 9, 2002 as the date of public hearing on an ordinance to vacate the East Lincoln Way right-of-way between I — 35 and Bell Avenue. Staff also recommends that City Council approve a resolution proposing to sell the property to the developers of the Panattoni Building expansion for $25,613.28 and establish April 9, 2002 as the date of public hearing on the resolution to sell the property. No. 5137-01A. Dear Mayor& Council: On the behalf of Panattoni Development Company, we are requesting the vacation of a portion of Lincoln Way right of way as shown on attached Exhibit A. The right of way would be vacated to the adjoining property owned by the Panattoni Development Company. The addition of this excess right of way to Panattoni will allow them to increase the size of the proposed building expansion from 300,000 square feet (s.f.) to 325,000 s.f. The additional 25,000 square feet will add approximately $850,000 of valuation to the project. Exhibit B shows the footprint of the 325,000 square foot building expansion. The additional property is needed to meet the ordinances 40 foot setback requirement. The excess right of way will be used for an access road around the building. The right of way is currently home to a public sanitary sewer (to Barilla) and numerous phone cables. Neither of the sewer or the phone lines will be displaced by the Panattoni improvements. An easement would be provided to leave those utilities in place. In addition, the vacation of this right of way does not interfere with the drainage in Lincoln Way or with travel in Lincoln Way. Panattoni is requesting the land be deeded to them at the cost of$1 as due consideration. Panattoni has incurred considerable expense in acquiring the existing 3 four properties. Three of the properties have existing businesses that are being relocated into new facilities at Panattoni's expense. Panattoni has also purchased property from Hach to provide locations for two of the businesses and the third business is building in the Ames Community Development Park. In addition to building new buildings, Panattoni is providing relocation expenses and has to demolish the existing buildings to make way for the expansion.
