INGRESS/EGRESS EASEMENT
THIS EASEMENT is entered into by and between Nineteen Sixty Corporation,hereinafter
referred to as"First Party" and Bradshaw Farms. L.P., hereinafter referred to as"Second Party".
WHEREAS, First Party is the titleholder of the real estate described as follows:
The East Half of the West Half of Section 24 and the West Half of the East Half of
Section 24, all in Township 83 North,Range 24 West of the 5t'P.M., Story County,
Iowa, EXCEPT the following described property: Beginning at the Southwest
Quarter of Section 24, Township 83 North, Range 24 West of the 5' P.M., Story
County,Iowa;thence Northerly along the West line of the Southwest Quarter 20 feet;
thence East parallel to the South line of the Southwest Quarter 1,322.5 feet;thence
North 0°30'West along the West line of the Southeast Quarter392.5 feet;thence East
99 feet; thence South 0030'East 99 feet;thence East 643.5 feet;thence South 0°30'
313.5 feet;thence West along the South line of the Southwest Quarter 2,065 feet to
the point of beginning.
WHEREAS, Second Party is the titleholder of the real estate described as follows:
The West Half of the Northwest Quarter of Section 24, Township 83 North, Range
24 West of the 5"'P.M., Story County, Iowa, EXCEPT beginning at the Northwest
corner thereof, thence South 0°43'East along the West line of said Section 1,642.0
feet;thence North 89030'East 270.0 feet;thence North 0°43'West 730.0 feet;thence
North 20°12'West 650.6 feet;thence North 2'01' West 299.6 feet;thence Westerly
along the North line of said Section 46.8 feet to the point of beginning, ALSO
EXCEPT the West 270.0 feet of the South 1,005.4 feet thereof.
WHEREAS, First Party and Second Party respective parcels of real estate must share a
common access.
NOW THEREFORE, the parties hereto for their mutual consideration agree as follows:
1. That First Party hereby grants and conveys to Second Party a perpetual Easement
for Ingress and Egress over a part of First Party's real estate as shown on Exhibit
"A" and as legally described on Exhibit `B", both attached hereto and by reference
made a part hereof, to be used jointly by both parties as a common entrance and as
access by Second Party to Second Party's real estate adjacent thereto.
2. That the parties' rights and obligations hereunder shall extend to their tenants,
licensees, and invitees and First Party shall keep the access easement free of
obstacles, obstructions, hazards or other impediments to the free use thereof.
3. That First Party and Second Party shall be jointly responsible to maintain and repair
the Ingress/Egress easement area.
4. That this Easement shall run with the land and be binding upon and inure to the
benefit of both the First Party and Second Party and their successors and assigns.
5. That the signature or execution of a lienholder, a tenant or a spouse regarding real
property herein shall serve as an acceptance and subrogation of their interest hereto.
IN WITNESS WHEREOF this Easement is executed on the date set beside each of the
parties hereto.
