WATER MAIN EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That (1/we), Riverview Apartments of Ames, LLC, its successors and assigns, (do/does)
hereby grant unto the City of Ames, Iowa, a municipal corporation the perpetual right to
enter upon the land described and the perpetual right to construct, reconstruct, clean
up, operate, maintain, and cover over and repair a water main upon, under, and across
the land described as follows:
DESCRIPTION:
The north 15' of a part of the north 35' of the south 299' of the N'/ of the NW% of the
SW% of Section 26, T84N, R24W of the 5th P.M. in the City of Ames, Story County,
Iowa, described as follows:
Commencing at the W'/4 of said Section 26; thence S 00 14' 30" E along the west line of
the SW% of said Section 26 a distance of 404'; thence east along the north line of the
south 264' of the N'/z of the NW% of the SW% of said Section 26 a distance of 605; to
the easterly ROW of Grand Avenue; thence northwesterly along said ROW, around an
8,660' radius curve concentric with and 65' radially distant from the centerline of Grand
Avenue, an arc distance of 35.04' (the long chord bears N 030 10' 25" W 35.04') to the
point of beginning; thence east along the north line of said south 299' a distance of 405;
thence south 15; thence west along a line 15' south of and parallel to the north line of
said south 299' a distance of 404.95' to the east ROW of Grand Avenue; thence
northwesterly along said ROW line to the point of beginning.
Containing 6,074.6 s.f., more or less.
See attached plat marked and made a part hereof.
The foregoing rights are granted upon the express condition that the City of Ames,
Iowa, will assume all liability for all damages to the above described property caused by
the City's failure to use due care in its exercise of the rights granted.
