COUNCIL ACTION FORM
SUBJECT: Easement Agreement with Iowa State University for Trail Development
in the Elwood Pasture Parcel.
BACKGROUND:The City received a State of Iowa REAP grant to install an 8'
wide hardsurface trail and a 10' wide pedestrian/bicycle bridge in the Squaw
Creek Greenway System. This site in owned by Iowa State University and, as
shown on the attached map, is located south of 6t" Street, north of Lincoln Way,
and east of Elwood Drive. This 30-acre parcel is bordered on the east by Squaw
Creek.
This section of trail is the third phase of a comprehensive trail system that will link
Brookside Park on the north and Stuart Smith Park on the south which then
connects into the existing bike trails located on 13t" Street and South 4m
A 20' wide easement is needed from Iowa State University so that the trail and
bridge can be installed on their property. Because of the substantial investment
that will be required for this project (approximately $46,700 for the bridge and
$101,000 for the path), staff was seeking an easement agreement with ISU that
would assure that our citizens would have the benefit of these facilities for a
substantial period of time. The terms regarding the duration of this easement that
were acceptable to the University are as follows:
❑ The easement will continue as long as land in the easement is used by the
City as a bicycle path. (Paragraph 10)
❑ During the next thirty years, the University can force the City to relocate the
path, but they must provide some other suitable location that will allow the
path to connect to the bridge that is being constructed as part of this project.
(Paragraph 8)
❑ If the City is required to relocate the path within the next twenty years, then the
University will pay the City the depreciated value of the path.
The Board of Regents will take action on this Agreement on July 18th. Subject to
their approval, staff will prepare a Council Action Form for Award of Contact for the
f
bridge for the July 201 City Council meeting. It is anticipated that the bridge and trail
will be installed by November 2001.
ALTERNATIVES:
1. Approve the Easement Agreement with Iowa State University.
2. Do not approve the Easement Agreement and refer back to staff to attempt to
negotiate better terms with the University.
CITY MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative
#1 approving the Easement Agreement with Iowa State University for a bicycle path.
