BACKGROUND: The developer of Somerset Subdivision platted the 6th Addition with a 24' wide right-of- way for an alley between Aspen Road and Bristol Drive just west of Somerset Drive. Note the attached map. The alley was dedicated to the City of Ames at the time this subdivision plat was approved. Subsequent to the platting, the City approved modifying the conceptual development plan for Somerset Subdivision to eliminate this alley and allow the developer to replace the alley with a bicycle path. Also the developer has agreed to increase the amount of landscaping along the bicycle path to screen the apartment lots west of the alley from the single-family lots east of the alley. The developers' intent is to transfer the alley right-of-way to abutting lots and construct the bicycle path in an easement on what would have been the east half of the alley right-of-way. If the City decides to vacate and transfer the alley, the entire alley will be transferred to the developers who will transfer the appropriate amount of alley right-of-way to the lots abutting the east and west sides of the alley. According to City policy for disposing of City right-of-way, the value of the alley is to be determined and payment is to be made to the City before the vacated property can be transferred. Based on this policy, the land is worth $6,146.59. In this case, since the City has approved the change to the Somerset Subdivision Conceptual Development Plan to eliminate the alley and the City has not incurred any costs since the alley has never been developed, staff feels that the City Council should waive the City policy for disposing of City right-of-way and transfer the alley to the developers free of charge. The value received for the land would be the construction of the bikepath and the landscape screening. ALTERNATIVES: 1. Waive City policy for disposing of City right-of-way and authorize transferring the north/south alley between Bristol Drive and Aspen Road in Somerset 6tn Addition to the developers of Somerset Subdivision at no cost and set November 27, 2001 as the date to hold the public hearing on the vacation and transfer. CAF —Vacate/Transfer Alley November 13, 2001 Page 2 2. Follow City policy for disposing of City right-of-way and sell the alley to the developers. The sale price would be $5,531.93. In order to initiate the sale process, Council should establish November 27th as the date to hold the public hearing on vacating the alley. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt alternative number 1 thereby waiving City policy for disposing of City right-of-way and authorize transferring the north/south alley between Bristol Drive and Aspen Road in Somerset 6th Addition to the developers of Somerset Subdivision at no cost; and establish November 27, 2001 as the date for the public hearing.
