Klaus, City Attorne DATE: September 18, 2001 SUBJECT: Alley Vacated, Bike Path Established, Somerset Sixth This is to follow up our conversation of September 13,in which you affirmed a desire to vacate the 24' alley in Somerset Sixth, and replace it with an easement for an eight-foot wide bike path that would abut on the west line of Lots 18 through 75. With this are proposed Council measures aid instruments necessary to that end, as follows: 1. Legal notice on enactment of an ordinance to vacate the alley 2. Ordinance to vacate the alley 3. Resolution proposing quit claim of land to Hunziker Trust,Furman Trust, and R.Friedrich & Sons Inc. 4. Legal notice of hearing on deed of land 5. Resolution approving deed of land 6. Bike path easement 7. Quit claim deed G + , TIfieproefts ca rbe started°at the Council's meeting of Sept 25�, At that meeting the Council could pass the resolution proposing the conveyance. The notices could both then be published not less than four nor more than twenty days before the hearing on both the ordinance to vacate and the deed to convey on October'NThe Council could suspend the rule on three passages of the ordinance and conclude its proceedings on the matter at the October 9 meeting. The proceedings as prepared assume that the developers are required to build a paved bike path at no cost to the City as consideration for the deed of land. A blank is left to express any additional cash payment required for the land.
