COUNCIL ACTION FORM
SUBJECT: EASEMENT AGREEMENT WITH BLAKE DELANEY
BACKGROUND:
City Well No. 8 has been out of service since late 1999 due to a failure in the underground well
casing. Design of a replacement City Well No. 8A is under way with plans to begin construction
this summer. Abandonment of the original well is included in this project.
In order to construct the well, right-of-way easements are required from two property owners. The
first utility construction easement was approved by Council on March 6, 2001. A copy of the
second negotiated ingress/egress easement is attached. As part of this agreement, Public Works
will divert surface drainage from the bike path in the right-of-way north to 6th Street away from Mr.
Delaney's property. This will be at no cost to the property owner.
Funding for purchase of the easement agreement is included in the approved CIP which includes
a total of$120,000.
ALTERNATIVES:
1. Approve the easement agreementwith Blake Delaney and authorize payment in the amount
of$1,500.00.
2. Do not approve the easement agreement at this time.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative No. 1.
