Beginning at the NW Comer of said Lot 6;thence S89°49'15"E, 140.00 feet along the North lone of said Lot 6 and Lot 5 to the NE corner of Lot 5;thence S00023'09"E, 9.97 feet along the East line of Lot 5;thence S87°49'25"W, 13.31 feet;thence S02°10'35"E,2.50 feet;thence S 87049'25"W, 67.50 feet;thence S02°10'35"E,2.50 feet;thence S 87°49'25"W,46.76 feet to a point on the West line of said Lot 6;thence N00°24'20"W, 15.72 feet on said West line to the Point of Beginning, containing 2,029 Square Feet. This easement is given in fulfillment of a certain contract dated w Z� , 20M_,and is on file in the City of Ames Public Works Department. The additional amount of$ 8,808.00 , as agreed to by contract, is paid as severance damages to the remaining property. This easement and transfer is exempt from transfer tax. Iowa Code Sec. 428A.2(17). This easement is being acquired for public purposes and a Declaration of Value is not required. Iowa Code Sec. 428A.1. Grantors do hereby covenant with grantees,and successors in interest,that grantors hold the real estate by title in fee simple; that they have good and lawful authority to sell and convey the real estate;that the real estate is free and clear of all liens and encumbrances except as may be above stated; and grantors covenant to warrant and defend the real estate against the lawful claims of all persons except as may be above stated. Each of the undersigned hereby relinquishes all rights of dower, homestead and distributive share in and to the easement.
