HomeMy WebLinkAboutA003 - Council Action Form dated May 23, 2000 Item # Date: May 23, 2000 COUNCIL ACTION FORM SUBJECT: ACCEPTANCE OF EASEMENTS FOR WATER MAIN AND ELECTRIC LINES IN REIMAN GARDENS BACKGROUND: Prior to the construction of Elwood Drive in the early 1970's, Beach Avenue ran from the ISU campus south to Oakwood Road and out of the City. When Elwood Drive was completed, Beach Avenue was connected into Elwood Drive and did not continue south. A few years later, the platting of Gateway Hills Subdivision created Mortensen Parkway and Beach Avenue was connected to Mortensen Parkway as a means of limiting the through traffic from the residential area. Through all of these changes, the City retained the original right of way that provided for Beach Avenue to go south and connect to Elwood Drive. Please note the attached map. In 1993, ISU requested that the City transfer the old right of way to them for use in the Reiman Gardens. Council approved the transfer of the land subject to the retention of easements for the utilities that existed in the area. Currently the City has a water main and an overhead electric line passing through the area. Since Reiman Gardens is expanding into the area covered by the old right of way, the transfer of the land is now critical. Staff has been working with ISU officials over the past several months to reach agreement on the appropriate language for the easement documents. ALTERNATIVES: 1. Accept the water main and electric easements that are on the old Beach Avenue right of way and complete the transfer of the land to Iowa State University. 2. Reject the easements and prevent the transfer of the land. This action will restrict the development of Reiman Gardens. MANAGER'S RECOMMENDED ACTION: It is recommended by the City Manager that the City Council adopt alternative number 1 and accept the water main and electric easements that are on the old Beach Avenue right of way and complete the transfer of the land to Iowa State University.
