That we, Erben A. Hunziker and Donald M. Furman hereby grant unto t e City
of Ames, Iowa, a municipal corporation, its successors and assigns, the perpet-
ual right to enter upon the land described and the perpetual right to con-
struct, reconstruct, clean up, operate, maintain, and cover over and repair
sanitary sewer, watermain, and bike path upon, under, and across the land
described as follows:
Description
Sanitary Sewer
A permanent easement across Lots Five (5) and Six (6), Landmark Subdivision;
in the City of Ames, Story County, Iowa; ten (10) feet on each side of the
following described centerline:
"Commencing at the southwest (SW) corner of said Lot Five (5); thence north,
32.70 feet along the west line of Lot 5, to the point of beginning; thence south
89036111" east, 51.13 feet; thence south 85136125" east, 376.05 feet to the point
of ending, a point on the south line of Lot 6, which is south 89*31125" west,
58.91 feet from the southeast (SE) corner thereof.
Water Main Loop
A permanent easement across Lots Five (5), Six (6), and Seven (7); Landmark
Subdivision, in the City of Ames, Story County, Iowa; five (5) feet on each
side of the following described centerline:
"Commencing at the southeast (SE) corner of said Lot Seven (7); thence north,
10.00 feet along the east line of Lot 7, to the point of beginning; thence west,
230.95 feet (to a point designated "A"); thence north, 71.60 feet; thence north
45000100" west, 13.04 feet to the east line of Raphael Avenue, and the point of
ending."
AND
"Beginning at a point designated "A"; thence south, 100.00 feet to the point of
ending."
Bike Path
"The east twenty (20) feet of the south 140.00 feet of Lot Seven (7), Landmark
Subdivision."
"The east ten (10) feet of Lot Seven (7), Landmark Subdivision; EXCEPT the

The foregoing rights are granted upon the express condition that the City of
Ames, Iowa, will assume all liability for all damages to the above described
property caused by the City's failure to use due care in its exercise of the
rights granted.
