i Item# Date: January 11, 2000 COUNCIL ACTION FORM SUBJECT: PUBLIC HEARING FOR 13s" STREET AND DUFF AVENUE INTERSECTION IMPROVEMENTS BACKGROUND: The 13th Street and Duff Avenue intersection improvements project was included in the 1998199 budget. The project provides for construction of left turn lanes on 13th Street and on Duff Avenue to increase safety and reduce delays for traffic using this intersection. In order to accomplish this, it will be necessary to widen both 13th Street and Duff Avenue approximately 11 feet to provide enough pavement width for four through lanes of traffic and left turn lanes. The turning radiuses on the four corners of the intersection will also have to be enlarged to better accommodate right turn movements of trucks. The existing traffic signals will have to be relocated and replaced with new equipment. Stone sewer and storm sewer intakes will also need to be reconstructed to accommodate the widening project. The overhead electric line along the south side of 13th Street has to be moved to accommodate the widening required. The existing paving is 45' centered in a 66' wide right-of-way. After the pavement is i widened to 56', there is only 5' of right-of way remaining for sidewalk construction on each side of 13th Street and Duff Avenue. This would necessitate the sidewalk being placed right at the back of curb. Staff conducted a public meeting to discuss the project with the residents affected by the project and heard concerns about clearing snow from their sidewalks if snow removal operations plowed snow onto their walks and pedestrian safety. Staff presented these concems to City Council and City Council adopted a policy that states that the minimum separation between the curb and face of the walk should be 6' unless there are extenuating circumstances that prevent the separation from occurring. The project was redesigned with a 6' separation between the curb and sidewalk where possible. It was not feasible to relocate the sidewalk along the south side of 13th Street between Douglas Avenue and Duff Avenue and along the west side of Duff Avenue between 12th Street and 13th Street to provide the 6' separation. The McFarland Clinic parking lot is located too close to the right-of-way to accommodate relocation of the sidewalk. Staff conducted another public meeting to discuss the revised plans with the residents earlier this year and started the appraisal process for acquisition of easements for sidewalks. The proposed design allows for purchase of easements as opposed to outright acquisition of property. This use of easements will prevent the creation of zoning non-conformities with respect to building setbacks. CAF—Public Hearing I Th& Duff January 11, 2000 Page 2 New legislation requires written notification to each property owner at least 30 days prior to the time the City Council adopts a measure to declare its "intent to proceed with a public improvement and the acquisition or condemnation, if necessary, of the property." This requirement includes identification and notification to all property owners, who may be involved in the proposed intersection improvement project, even if the acquisition is only an easement for the sidewalk. Many of these owners have indicated a reluctance to sell the easement to the City and, condemnation may become necessary. Therefore, in accordance with the legal requirements, Council authorized staff to notify all potential property owners before actually moving ahead with the project. The City Council established January 11, 2000 as the date of public hearing to decide if the 13th Street and Duff Avenue intersection improvements project is to be approved, delayed, or rejected. It is estimated that the design change to provide the 6' separation distance between the curb and sidewalk will cost $293,000 for additional design fees, appraisal costs, appraisal review costs, negotiation fees, compensation for easements and contingency for condemnation. Therefore the estimated project cost has increased from $600,000 to $893,000. ALTERNATIVES: 1. Approve the 13th Street and Duff Avenue intersection improvements project and authorize the acquisition of the easements for right-of-way through negotiation, or if necessary, through condemnation. 2. Delay the 13th Street and Duff Avenue intersection improvements project. 3. Reject the 13th Street and Duff Avenue intersection improvements project. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve the 13th Street and Duff Avenue intersection improvements project and authorize the acquisition of the easements for right-of-way through negotiation, or. if necessary, through condemnation. Council should be aware that action directing the staff to proceed with easement acquisition does not commit the Cii.y to complete the project. If bids come in too high or some other situation comes up, Council can still stop the project implementation.
