Description (Location, purpose and specifications)
Renewal of Permit #63 issued December 2, 1966 which reads as follows:
Attached sheet contains provisions of this permit.
The Permittee is presumed to be familiar with all laws, ordinances
and regulations that may effect employees, materials or equipment
used in or upon the work. The Permittee shall indemnify and save
harmless the State of Iowa, State Conservation Commission, and all
its officers and agents from claims or liability of any character,
arising out of any acts or damages that might result from the instal-
lation — or construction of — the project described in the permit.

The State Conservation Commission hereby grants to the City of Ames,
Iowa, the right to construct, reconstruct, operate, maintain, repair
and remove a sanitary sewer in 'the location as hereinafter described
across and under the property of the State of Iowa used by the State
Conservation Commission, and located in Sectinn 13 and 14, Township
83 North, Range 24 West of the 5th P.M. so long as the said City
operates and maintains said sanitary sewer after its installation.
A strip of land twenty (20) feet in width, lying ten (10) feet on eact"
side of a line described as follows:
Beginning in the south line of the NW'k SW2, Section 13,
Township 83 North, Range 24 West of the 5th P.M. Story County,
Iowa, 310 feet + east of the SW corner, NW k SW k said Section
13, thence N4025'15"E634 feet + thence N38043'45"W229.25 feet,
thence N57008'451IW173.94 feet,—thence N1o42'45"W315.96 feet,
thence N19029'15"E139 feet + to the east line NE k SE k Section
14 also beginning in the east line of the SE k NE k Section 14
at a point 18 feet + north of the E k corner Section 14, thence
N30003'45"W168 feet—+ to the north line of the south 154.8 feet
of the SE k NE k Section 14.
There is also hereby granted a temporary right of ingress and egress
over and across adjacent land and on either side of the above described
line only during the period of construction.
The foregoing right is granted upon the following express conditions,
the breach of any of which will give the State Conservation Commission
the right and power to re-enter.
(1) That the said City shall construct, operate and maintain said
sanitary sewer in a manner consistent with normal and accepted practices
of the industry.
(2) That upon completion of said construction the said City shall
replace, restore or pay to the satisfaction of the State Conservation
Commission any and all damage to the property of said State of Iowa which
shall be occasioned by the construction, maintenance or operation of said
sanitary sewer through the premises above described, except for trees that
have to be removed within the permit for the initial construction.
(3) That said City will protect, indemnify and save harmless the
State of Iowa and the State Conservation Commission from any and all claims,
demands, judgments, loss, cost or expense for injury to or death of persons,
or damage to property of any person whomsoever (including employees and
representatives of both parties hereto) in any manner arising from or grow-
ing out of the negligence of the said City, its agents, servants or employees,
in the construction, maintenance, repair, existance, use or removal of said
sanitary sewer herein permitted.
(4) That none of the cost of constructing, reconstructing, operating,
maintaining or repairing said sanitary sewer shall be charged or assessed
against adjacent property of' the State of Iowa.
(5) That said City shall not transfer or assign this permit or any
interest or right therein without the written consent of the grantor, nor
shall the consent of the grantor to such assignment be construed to give the
assignee any other or greater or different rights than those hereby given
to said city.
(6) In the event the said City or any assignee thereof discontinues
the operation and maintenance of said sanitary sewer, this permit shall
terminate, and said City or assignee shall, if requested by said Commission,
remove its sanitary sewer and appurtenances from the locations hereinbefore
described.
(7) That said City will permit connections to the above described
sewer line, without charge, provided that such connection or connections shall
meet existing ordinances and requirements covering this type of installation.
The above are the provisions of Construction Permit #2 issued December
16, 1966 to City of Ames, Ames, Iowa.
