BACKGROUND: The attached request for modification of the storm sewer easement on Lot 14, Block 3, Parkview Addition (3208 Ross Road) was received by staff. The owner granted the easement to the City in 1983 for construction of storm sewers to eliminate the erosion that was occurring on the property. At the present time, the owner wishes to construct a dwelling on the property. Because of the gully that crosses the lot, the owner has obtained approval from the Zoning Board of Adjustment to reduce the front yard setback by 5 feet. The original easement was contained in the regular 30 foot wide front yard setback. Because of the change to a smaller front yard, the owner has asked the City to modify the easement. The present easement is 20 feet wide and the maintenance work is capable of being completed in 15 feet. ALTERNATIVES: 1. Accept the vacation of the twenty foot wide easement in exchange for a fifteen foot wide easement. 2. Reject the request. MANAGER'S RECOMMENDED ACTION: It is recommended by the City Manager that the City Council vacate the existing storm sewer easement on Lot 14, Block 3, Parkview Addition in exchange for a new easement that is fifteen feet in width.
