STORM WATER DETENTION POND EASEMENT
For and in consideration of the sum of $1.00 and other valuable consid-
eration, the receipt and sufficiency of which are hereby acknowledged, the
�(U grantor, WAL*MART STORES, INC., its successors and assigns, does hereby grant
and convey to the grantee, CITY OF AMES, IOWA, a municipal corporation, a
perpetual easement upon the following described premises:
All that part of the SEJ NWJ of Section 14, Township 83
North, Range 24 West of the 5th P.M. , Story County, Iowa
described as follows:
Q 1151 Commencing at the center of said Section 14, thence north
3 00*00' west on the I section line a distance of 706.0
O �t l feet; thence north 89°32'45" west 399.97 feet parallel to

M1 beginning containing 4.67 acres, more of less.
all as described and shown on the plat attached hereto and by this reference
made a part hereof, for the purpose of constructing, repairing, maintaining,
and operating a storm water detention pond upon the premises hereinabove
described.
This easement is granted upon the express condition that the said City
of Ames, in the maintenance of the storm water detention pond, shall do no
unnecessary injury to any trees, shrubs, lawns, buildings, fences or appurte-
nances within the described area.
For the purposes herein set out, the grantee, its officers, employees,
agents, licensees, successors and assigns shall at all times have the right
zs� and privilege of access to the premises herein above described.
This rant of easement and right-of-wa shall be binding upon the heirs

line a distance of 706.0 feet; thence north 89° 32' 45" west 399.97 feet parallel to the
south line of the NWY4 of said Section 4 to the point of beginning; thence continuing north
890 32'45"west 920. 69feet to the 1/41/4 section line;thence north 00" 00' 45" west 379.79
feet on said '/41/4 section line; thence southeasterly 524.64 feet on a 1,567.04 foot radius
curve, concave southwesterly, the chord for which bears south 71° 47' 30" east and has
