STORM WATER DETENTION POND EASEMENT
For and in consideration of the sum of $1.00 and other valuable consid-
eration, the receipt and sufficiency of which are hereby acknowledged, the
grantor, WAL*MART STORES, INC., its successors and assigns, does hereby grant
and convey to the grantee,.', CITY OF AMES, IOWA, a municipal corporation, a
perpetual easement upon the following described premises:
All that part of the SE1 NW1 of Section 14, Township 83
North, Range 24 West of the 5th P.M. , Story County, Iowa
described as follows:
Commencing at the center of said Section 14, thence north
00000' west on the 1 section line a distance of 706.0
feet; thence north 89°3245" west 399.97 feet parallel to
the south line of the NW1 of said Section 4 to the point
of beginning; thence continuing north 89°32'45" west
920.59 feet to the 11 section line; thence north 000
00'45" west 379.79 feet on said 11 section line; thence
southeasterly 524.64 feet on a 1,567.04 foot radius
curve, concave southwesterly, the chord for which bears
south 71°47'30" east and has a length of 522.19 feet;
thence south 62012' east 480.11 feet to the point of
beginning containing 4.67 acres, more of less.
all as described and shown on the plat attached hereto and by this reference
made a part hereof, for the purpose of constructing, repairing, maintaining,
and operating a storm water detention pond upon the premises hereinabove
described.
This easement is granted upon the express condition that the said City
of Ames, in the maintenance of the storm water detention pond, shall do no
unnecessary injury to any trees, shrubs, lawns, buildings, fences or appurte-
nances within the described area.
For the purposes herein set out, the grantee, its officers, employees,
agents, licensees, successors and assigns shall at all times have the right
and privilege of access to the premises herein above described.
