For and in consideration of the sum of $1.00 and other valuable consid-
eration, the receipt and sufficiency of which are hereby acknowledged, the
grantor, WAL*MART STORES, INC., its successors and assigns, does hereby grant
and convey to the grantee, CITY OF AMES, IOWA, a municipal corporation, a
perpetual easement and right-of-way in, over, upon, through and under the
following described premises:

hereinabove described.
This easement is granted upon the express condition that the said City
of Ames, in the construction and maintenance of the storm sewer, shall do no
unnecessary injury to any trees, shrubs, lawns, buildings, fences or appurte-
nances within the described area and shall restore the surface of the ground
to the same condition in which it was before the start of this improvement or
any future maintenance work, as near as such restoration can be made.
For the purposes herein set out, the grantee, its officers, employees,
agents, licensees, successors and assigns shall at all times have the right
and privilege of access to the premises herein above described.
This grant of easement and right-of-way shall be binding upon the heirs,
administrators and assigns of grantor.
WITNESS WHEREOF, the said grantor, WAL*MART STORES, INC. has caused
strument to be executed by its duly authorized representative.
