WATER MAIN EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
The undersigned,Armstrong Family Limited Partnership,its successors and assigns(hereinafter"Grantor"),
hereby GRANTS unto
the CITY OF AMES, IOWA (hereinafter "City"), a municipal corporation, its successors and assigns, the
perpetual right to enter upon the land described below and the perpetual right to construct, reconstruct, clean
up, operate maintain, and cover over and repair a water main,under and across the following described real
estate situated in Story County, Iowa:
LEGAL DESCRIPTION:
The west 15 feet of Lot Three of Armstrong's Second Addition.
The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all
liability for all damages to the above described property caused by the City's failure to use due care in its
exercise of the rights granted or in its use or maintenance of the water main.
Grantor,its successors and assigns,reserves the right to construct parking lot or drives on the above described
easement;to construct sanitary sewer,electric,gas,telephone and/or other utilities within the above described
easement providing such use does not interfere with the water main constructed by the City of Ames. Grantor,
its successors and assigns, shall have unrestricted use of the water main at no cost or expense.
