ELECTRIC UTILITY AND COMMUNICATIONS

KNOW ALL PERSONS BY THESE PRESENTS:
That MARY R. FITCH, AS TRUSTEE OF THE DONALD AND RUTH FURMAN IRREVOCABLE
TRUST, DATED July 1, 1991, her successors and assigns, for good and valuable
consideration, receipt of which is hereby acknowledged, does hereby grant unto the CITY
OF AMES, IOWA, a municipal corporation, its successors and assigns, the perpetual right
to enter upon the land hereinafter described and the perpetual right to construct,
reconstruct, maintain, repair and use, such electrical lines and other equipment for the
purpose of conveying electrical current for power and lighting purposes, and for
communication transmissions, upon, underground, over or across the land described as:
The East five feet of Lots Two and Three in Hunziker-Furman Sixth
Subdivision to Ames, Iowa, and the East five feet of that part of Lot One in
Hunziker-Furman Sixth Subdivision to Ames, Iowa, described as beginning
at the northeast corner of the sold Lot One, thence South twenty-one feet,
thence West one hundred twenty-eight and two tenth feet (128.2'), thence
North seventeen feet, thence East to the point of beginning,
all as shown on the plat attached and made a part hereof.
The foregoing rights are granted upon the express condition that the users of the granted
rights will assume liability for all damage to the real estate described herein caused by
failure to use due care in the exercise of the granted rights.

acknowledged that the person, as the fiduciary, executed the instrument as the voluntary
act and deed of the person and the fiduciary.
