UTILITIES RIGHT-OF-WAX PERMIT AND EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That we, Clinic Building Co. , Inc. do hereby grant grant unto the City
of Ames, Iowa, a municipal corporation, its successors and assigns, the
perpetual right to enter upon the land described and the perpetual right to
construct, reconstruct, clean up, operate, maintain, and cover over and
repair a Utilities Easement upon, under and across the land described as
follows:
DESCRIPTION:
Construction Easement, pertaining to lots 7 & 8, Block 3, Richmond's Addi-
tion, Ames, Iowa, as follows:
The East 48 feet of the South 31 feet of Lot 8.
The: West 60 feet of the South 31 feet of Lot 7.
-The. East 30 feet of the West 90 feet of the South 31 feet of Lot 7.
_The. East 48 feet of the West 138 feet of the South 19 feet of Lot 7.
A triangular portion of Lot 7 described as beginning at a point 90
feet East and 19 feet North of the SW corner of Lot 7; thence North 12
feet; thence SE to a point which is 103 feet East & 19 feet North of the SW
corner of Lot 7; thence West 13 feet to the point of beginning.
Permanent Easement, pertaining to lots 7 & 8, Block 3, Richmond's Addition,
Ames, Iowa, as follows:
The East 40.5 feet of the South 23.5 feet of Lot 8.
The West 60 feet of the South 23.5 feet of Lot 7.
The East 32 feet of the West 92 feet of the South 23.5 feet of Lot 7.
The East 46 feet of the West 138 feet of the South 14 feet of Lot 7.
A triangular portion of Lot 7 described as beginning at a point which
is 92 feet East and 14 feet North of the SW corner of Lot 7; thence North
9.5 feet parallel to the West line of Lot 7; thence SE to a point 103 feet
East and 14 feet North of the SW corner of Lot 7; thence West 11 feet to
the point of beginning.
See attached plat marked and made a part hereof.
The foregoing rights are granted upon the express condition that the
City of Ames, Iowa, - will assume all liability for all damages to the above
described property caused by the City's failure to use due care in its
exercise of the rights granted.
