Know all persons by these presents that Ron E. Jensen, Leslie M. Hanger,
Mary S. Hanger, James D. Smith, Carleton W. Smith, Sandra A McKee, their
heirs, successors, and assigns, Grantors do hereby grant and convey to City
of Ames, Grantee a permanent easement and right-of-way in which to
construct, reconstruct, operate, remove, repair, and maintain underground
pipelines and mains for the conveyance of sewage and control cable in,
over, across, through, and under the following described real property:
Description
A permanent easement 30' in width centered on a line more particularly
described as follows: Commencing at a point 1,293.46' N and 370.56' E of
the SW cor. Section 13 T83N R24W and running thence S 420 20' 23" E 113'
(more or less) to the point of beginning, thence continuing S 420 20' 23" E
1,650.48" to a point on the south line of said Section 13 T83N R24W
1,569.74' E of the SW cor. thereof. Also a temporary construction easement
15' in width on the east and 55' in width on the west parallel to and
abutting above described permanent easement. All located in the SW4 -
Section 13 T83N R24W of the 5th P.M. and containing 1.15 and 2.68 acres
respectively.
Reserving, however, in and to said Grantors, the right at all times to
enter upon and occupy the said real property or any part thereof and make
any proper use thereof so long as said occupancy and use do not infringe
upon, hinder, or limit the right herein granted to said City to construct,
reconstruct, operate, remove, repair, and maintain the said underground
pipelines and mains.
The foregoing rights are granted upon the express condition that the City
of Ames, Iowa, will assume all liability for all damages to the above de-
scribed property caused by the City's failure to use due care in its exer-
cise of the rightsgranted.
