RIGHT OF WAY PERMIT AND EASEMENT l"\ jj
Know all persons by these presents that United Bank & Trust, Trustee of the
Ronald Jordan Family Trust, Grantor, its heirs, successors, and assigns, do
hereby grant and convey to City of Ames, Grantee, a permanent easement and
right-of-way in which to construct, reconstruct, operate, remove, repair,
and maintain one underground sanitary sewer line consisting of pipe,
manholes, and protective structures for the conveyance of sewage and one
control cable system in and under the following described real property:

A permanent easement 55' in width 20' E. and 35' W. of a line more
particularly described as follows:
Becinning at a point 1101 eazt- of the N.E. Corner of the Swk NE% section 25
T83N R24W and running thence S 430 44' 42" E. 1,648.41' , thence S 190 12'
30" E. 76' more or less to the north R-O-W line of County Road E-57! All
located in Section 25 T83N R24W of the 5th P.M. and containing 2.17 acres
more or less.
Also a temporary construction and storage easement 110' in width on the
west abutting and parallel to above described permanent easement! Said
temporary easement extends to the center of the Skunk River on the East!
All located in Section 25 T83N R24W of the 5th P.M. and containing 8.3
gi p'' acres more or less.

(f) Reserving, however, in and to said Grantor, the right at all times to enter
► upon and occupy the said real property or any part thereof and make any
Q proper use thereof so long as said occupancy and use do not infringe upon,
Nhinder, or limit the right herein granted to said City to construct, recon-
struct, operate, remove, repair, and maintain the said underground sewer
CO line and control cable.
The foregoing rights are granted upon the express condition that the City
6 of Ames, Iowa, will assume all liability for all damages to the above de-
scribed property caused by the City's failure to use due care in its exer-
cise of the rights granted, including any damage to crops, pasture, trees,

RESOLUTION ACCEPTING GRANT OF EASEMENT
FROM THE RONALD JORDAN FAMILY TRUST FOR
SEWER LINE AND RELATED ITEMS PERTAINING
TO LINE TO NEW TREATMENT PLANT
_a BE IT RESOLVED, by the City Council of the City of Ames , Iowa,
�./ that the grant of easement by the Ronald Jordan Trust to the
City of Ames , dated August 1 , 1985 , . for a sewer line , shall
be and the same is hereby accepted in lieu of the grant and
easement delivered under date of November 20 , 1984 , but not
recorded. The earlier grant is hereby released and abandoned,
and said instrument shall be returned to the grantor.
Adopted this 13th day of August 1985 .
