RIGHT OF WAY PERMIT AND EASEMENT Know all persons by these presents that United Bank & Trust, Trustee of the Ronald Jordan Family Trust, Grantor, its heirs, successors, and assigns, do hereby grant and convey to City of Ames, Grantee, a permanent easement and right-of-way in which to construct, reconstruct, operate, remove, repair, and maintain one underground sanitary sewer line consisting of pipe, manholes, and protective structures for the conveyance of sewage and one control cable system in and under the following described real property: Description A permanent easement 55' in width 20' E. and 35' W. of a line more particularly described as follows: Beginning at a point 110' east of the N.E. Corner of the SWk NE'k Section 25 T83N R24W and running thence S 430 44' 42" E. 1,733.411 . All located in Section 25 T83NR24W of the 5th P.M. and containing 2.19 acres more or less. Also a temporary construction and storage easement 110' in width on the west abutting and parallel to above described permanent easement! Said temporary easement extends to the center of the Skunk River on the East! All located in Section 25 T83N R24W of the 5th P.M. and containing 8.3 acres more or less. Reserving, however, in and to said Grantor, the right at all times to enter upon and occupy the said real property or any part thereof and make any proper use thereof so long as said occupancy and use do not infringe upon, hinder, or limit the right herein granted to said City to construct, recon- struct, operate, remove, repair, and maintain the said underground sewer line and control cable. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all liability for all damages to the above de- scribed property caused by the City's failure to use due care in its exer- cise of the rights granted, including any damage to crops, pasture, trees, or fences.
