a permanent easement and right-of-way in which to construct, reconstruct,
operate, remove, repair, and maintain underground pipelines and mains for
the conveyance of sewage and control cable in, over, across, through, and 05077

Reserving, however, in and to Ray Holley and Lila Beth Holley , the
right at all times to enter upon and occupy the said real property or any
part thereof and make any proper use thereof so long as said occupancy and
use do not infringe upon, hinder, or limit the right herein granted to said
City to construct, reconstruct, operate, remove, repair, and maintain the
said underground pipelines and mains.
The foregoing rights are granted upon the express condition that the City
of Ames, Iowa, will assume all liability for all damages to the above de-
scribed property caused by the City's failure to use due care in its exer-
cise of the rights granted.

Also a temporary construction easement more particularly described as follows:
Beginning at a point 997.96' east of the N'h corner said Section 25 and running thence
east 15' thence southeast of and parallel to above described permanent easement a
distance of 8841 , thence east to the centerline of the Skunk River, thence south
along said centerline of the Skunk River to the south line of the N'h NE4 said Section
