Jennings in consideration of the sum of One o ar and other good and va ua e consideration, the receipt of which is hereby acknowledged, (do/does) hereby grant unto the City of Ames , Iowa, a municipal corporation, its successors and assigns , the perpetual right to enter upon the land described and the perpetual right to construct , reconstruct, clean up, operate, maintain, and cover over and repair a water main upon, under and across the land described asfollows : A permanenCERR T or e particularly described as follows: Commencing at a point 12.67 feet west of the northeast corner of Lot 1 of Caylors Subdivision and running thence south 180 feet parallel to said east line of Lot 1, thence east 20.0 feet to a point 7.33 feet east and 180 feet south of northeast corner of Lot 1, thence northwest to a point 2.67 feet west and 90 feet south of northeast corner of Lot 1, thence north 90 feet parallel to said east line of Lot 1, thence west 10 feet to point of beginning. Also a temporary construction easement 10 foot in width lying east. of and adjacent to said permanent easement, all located in the City of Ames, Story County, Iowa , and containing .05 acres and .04 acres respectively. See attached plat marked Exhibit A and made a part hereof. The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume all liability for all damages to the above described property caused by the City' s failure to use due care in its exercise of the rights granted.
