CORRECTED RIGHT OF WAY PERMIT AND EASEMENT
EASTWOOD OF AMES,INC.,Grantor,and the CITY OF AMES,IOWA,Grantee,do hereby agree that the
right of way permit and easement described herein corrects and replaces the description filed January 2, 1997,
as instrument number 97-00081 in the office of the Story County Recorder.
FOR AND IN CONSIDERATION of the sum of One Dollar($1.00) and other valuable consideration, the
receipt and sufficiency of which are hereby acknowledged,the Grantor,EASTWOOD OF AMES,INC.,does
hereby grant and convey to the Grantee,the CITY OF AMES,IOWA,a municipal corporation,its successors
and assigns, the perpetual right to enter upon the land described and the perpetual right to construct,
reconstruct, clean up, operate,maintain, and cover over and repair a water main easement upon,under, and
across the land described as follows:
That part of the Northeast Quarter (NEI/a) of the Southeast Quarter (SEI/a) of Section Two (2),
Township eighty-three(83)North,Range twenty-four(24)West of the 5th p.m.,in the City of Ames,
Iowa, and being 5.00 feet on each side of the following described centerline:
Commencing at the Southeast corner of Lot 2,Block 3,Ives Addition to Ames,being an official plat;
thence south 1°03'53"east along the west line of said Northeast'/4 of the Southeast'/4,a distance of
76.00 feet to the point of beginning;thence north 81051'38"east,45.56 feet;thence north 59°08'30"
east, 15.17 feet;thence south 30°34'30"east,6.34 feet;thence north 81051'38"east,13.04 feet;thence
north 86°08'39"east,81.50 feet;thence north 73°20'37"east,48.00 feet;thence south 89°51'59"east,
74.00 feet;thence south 79°35'17"east, 92.50 feet;thence south 86°34'33"east, 82.50 feet;thence
south 82°57'23"east,72.33 feet;thence south 1'05'11"east, 125.36 feet;thence north 88'55'16"east,
90.50 feet;thence south 1°04'44"east,6.00 feet to a point on the north line of Lot A,Block 1,of Lew
Cole's Subdivision,being an official plat,said point being 193.81 feet west of the Northeast corner of
said Lot A,Block 1,and being the point of terminus,easement lines extended and shorten to begin at
the west line of said Northeast'/4 of the Southeast'/4 and extended and shorten to end on said north
line of Lot A,Block 1; said easement contains 0.17 acres(7,428 s.f.).
See the attached Plat of Easement marked and made a part hereof.
The foregoing rights are granted upon the express condition that the users of the granted rights will
assume liability for all damage to the real estate described herein and any adjacent real estate caused
by failure to use due care in the exercise of the granted rights.
This grant of easement and right of way shall be binding upon the heirs, successors, and assigns of
the Grantors.
