RIGHT OF WAY PERMIT AND EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That (1/we), Wal Mart Stores Inc. (do/does) hereby grant unto the City of Ames, Iowa, a
municipal corporation its successors and assigns, the perpetual right to enter upon the
land described and the perpetual right to construct, reconstruct, clean up, operate,
maintain, and cover over and repair a water main easement upon, under, and across the
land described as follows:
DESCRIPTION:
A strip of land 10 feet wide, 5 feet each side of the following described centerline;
commencing at the SE corner of the NWi/a Section 14 T83N R24W of the 5th P.M., Ames
Story County, Iowa; thence west along the south line of said NWIA Section 14, 923 feet;
thence north 60 feet to the north right-of-way line of Airport Road and the point of
beginning; thence continuing north 643 feet; thence west 387 feet; thence south 646 feet
to the north right-of-way line of Airport Road containing 0.384 acres more or less.
See attached plat marked and made a part hereof.
The foregoing rights are granted upon the express condition that the City of Ames, Iowa,
will assume all liability for all damages to the above described property caused by the
City's failure to use due care in its exercise of the rights granted.
