See attached plat marked and made a part hereof. This easement will become null and void if a certificate of occupancy is not granted to Mr. Decker by May 15, 1999. The foregoing rights are granted upon the express condition that the City of-Ames, Iowa, will restore parking lot surfacing, landscaping, fencing, signage or other such improvements to equal or better condition if it is necessary to repair said water main. Further, the City of Ames will assume all liability for damages to the above described property caused by the City's failure to use due care in its exercise of the rights granted.
