WATER MAIN EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That I, Steven Richard Decker do hereby grant unto the City of Ames, Iowa, a municipal
corporation its successors and assigns, including any public utility designated by the
City, the perpetual right to enter upon the land described and the perpetual right to
construct, reconstruct, repair, maintain, and use underground pipelines and other
equipment on any part thereof for the purposes of conveying potable water on the land
described as follows:
DESCRIPTION:
The east 10 feet of Lot 5, Cooper's First Subdivision, Ames Story County, Iowa.
See attached plat marked and made a part hereof. This easement will become null and
void if a certificate of occupancy is not granted to Mr. Decker by May 15, 1999.
The foregoing rights are granted upon the express condition that the City of-Ames,
Iowa, will restore parking lot surfacing, landscaping, fencing, signage or other such
improvements to equal or better condition if it is necessary to repair said water main.
Further, the City of Ames will assume all liability for damages to the above described
property caused by the City's failure to use due care in its exercise of the rights granted.
