RIGHT OF WAY PERMIT AND EASEMENT WITH COVENANT
(S.E. 16TH & DAYTON ROAD)
THE UNDERSIGNED, Grantors, their successors and assigns, in considera-
tion of the sum of One Dollar and other considerations, receipt of which
is hereby acknowledged, do grant to the City of Ames., Iowa, a municipal
corporation, its successors and assigns, the perpetual right to con-
struct, reconstruct, maintain and use electric lines, consisting of
poles, wires, cables, conduits, fixtures, anchors and other similar
equipment, including the right to trim or remove trees within such area
where necessary to secure a clearance of 4 feet from the wires or poles,
and a right of access for mobile equipment and vehicles, together with
the right to extend to telephone, telegraph, television, electric or
power companies, or a company, the right to use separately or jointly
with the City of Ames the areas included in this easement for the
purposes above enumerated, over, upon, across or under the following
described real estate, situated in the County of Story, State of Iowa,
to-wit:
Beginning at a point 100 feet West and 33 feet South of the
Northeast corner of Section 13, Township 83 North, Range 24
West, and running thence South 20 feet, thence West parallel
to and 53 feet distant from the North line of said Section 13
a distance of 250 feet, thence North 20 feet to the South line
of South 16th Street, thence East 250 feet to the point of
beginning, all located in the Northeast 1/4 of Section 13,
Township 83 North, Range 24 West of the 5th P.M. in Story
County, Iowa and containing 0.09 acres more or less.
It is further promised by grantors that there shall be no construction
or erection of any building or structure on the described land or at any
other place where any part of such structure will be closer to the said
wires, conduits, cables, etc. than is allowed by the National Electric
Safety Code, ANSIC-2. Fences and materials storage is permitted, but
removal will be prompt on request of the grantee for exercise of rights
herein stated.
Additionally the City of Ames shall have the right and easement to
utilize the described land for the accumulation and passage of water
draining from adjacent land; and, shall have the right to construct and
maintain thereon such ditch or conduit as the City' s engineers shall
deem appropriate to that purpose.

The grantors, their successors and assigns covenant further that they
shall make no claim or demand against the City of Ames, its officers and
employees, by reason of any damage to the described land or to the land
and buildings adjacent thereto resulting from or arising out of erosion
caused by use of the easement and for drainage as aforesiad, and shall
defend, indemnify and save the said City and its officers and employees
harmless agsint any such claim.
