V STORY COUNTY.IOWA 2+1. + FUD FOR RSCtPJ) -t-dD4/ F Jull $ 02 V9 vo; GENERAL UTILITY WMLWM w RIGHT-OF-WAY PERMIT AND EASEMENT rw�o rUNDERSIGNED PARTY, Iowa State University Research Foundation, Inc. , its successors and assigns, in consideration of the sum of one dollar ($1.00) , the receipt of which is hereby acknowledged, does hereby grant to the City of Ames, Iowa, the perpetual right to construct, reconstruct, maintain, and use its underground water, storm and sanitary sewer systems; and, the perpetual right to construct, reconstruct, maintain and use electric lines, consisting of poles, wires, cables, conduits, fixtures, anchors, and other similar equipment, including the right to trim or remove trees within such area where necessary to secure a clearance of four feet from the wires or poles, and a right of access for mobile equipment and vehicles, together with the right to extend to telephone, telegraph, television, electric or power companies, or a company, the right to use separately or jointly with the City of Ames the areas included in this easement for the purposes above stated, over, upon, across, or under the following described real estate: C rn 5^13 A forty (40) foot wide easement across Lot Thirteen (13) , Mission ;-' rn Ridge Subdivision; Twenty (20) feet on each side of the following CD rC oo described centerline: 0 -n � O "Commencing at the most Northerly corner of Lot Twelve (12) , > Mission Ridge Subdivision; thence Northwesterly, along a 430.00 i-,-+ foot radius curve, concave northeasterly, an arc distance of 169.43 feet (the long chord bears N 340 33' 06" W, 168.34 feet) , to the = Point of Beginning; thence S 77' 00' 00" W, 101.30 feet to the Point of Ending." Note: This easement is a redefinition of and is a wholly contained existing easement, which was platted within The c t° Gateway Hills Subdivision; and recorded in Book 147, Pages 275-276, 0o on December 29, 1978. It is further promised by grantor that there shall be no construction or installation of any building or structure on the described land or at any other place where any part of such structure will be closer to the said wires, conduits, cables, etc. than is allowed by the National Electric Safety Code, ANSIC-2. Fences and storage is permitted, but removal shall be prompt on request of the grantee for exercise of the rights herein stated. The forgoing rights are granted upon the express condition that the City of Ames shall assume responsibility for all damage to the above described prop- erty caused by the City's failure to use due care in the exercise of its granted right; but, the City of Ames shall have no obligation to restore or compensate for the removal of pavement or other obstructions in exercise of the easement rights herein granted.
