That we, National Farmers Organization, Inc. for good aARlitWONS
valuable consideration, receipt of which is hereby acknowledged,
do hereby grant unto the City of Ames, Iowa, a municipal
corporation its successors and assigns, the right to enter upon
the land described and the right to construct, reconstruct, clean
up, operate, maintain, and cover over and repair a storm sewer
upon, under, and across the land described as follows:
DESCRIPTION:
A permanent easement of the surface and the area extending to a
depth of twenty (20) feet below the surface, ten (10) feet in
width centered on a line more particularly described as follows:
Commencing at the NE corner of Lot 3, Oakwood Second Addition and
running thence south 00*03123" west 25' to the point of
beginning; thence north 89*2814911 west 781.34 ' (the "First
Permanent Easement") .
Also a permanent easement more particularly described as follows:
the surface and the area extending to a depth of twenty (20) feet
below the surface commencing at the SW corner of said Lot 3 and
running thence north 186.47 ' to the point of beginning; thence
east ten (10) feet, thence north 00003123" east 176.561 , thence
north 89028149" west to the east right-of-way line of Green Hills
Drive, thence southerly along said east right-of-way line to the
point of beginning (the "Second Permanent Easement") .
Also a temporary construction easement ten (10) feet in width
lying south of and abutting the above described First Permanent
Easement (the "Temporary Easement") . The Temporary Easement as
granted herein shall be void and of no further effect as of
August 31, 1991.
The First Permanent Easement, the Second Permanent Easement and
the Temporary Easement shall be known herein collectively as the
"Easements. " Q4
All located in the City of Ames, Story County, Iowa and
containing a total of 0.46 acres in the First Permanent Easement
and Second Permanent Easement together, and 0. 18 acres in the
Temporary Easement. S
See attached plat marked and made a part hereof.
PROVISO: Q
The foregoing rights are granted upon the express conditions 6o
that:

1. The City of Ames, Iowa, will assume all liability Cr
all damages to the above described property caused by the City's
failure to use due care in its exercise of the rights granted and
attached stipulations;
2. The City of Ames shall maintain and repair all areas
comprising the Easements and the improvement therein in good
order and condition for the life of each of the Easements;
3 . The City of Ames for the life of each of the Easements
shall restore the surface of the areas comprising the Easements
and the areas adjacent thereto immediately following any
installation of or repair to improvements therein to the
condition of such surface areas prior to such installation or
repair, including but not limited to any necessary repair to any
asphalt or cement surface due to cracks in such surface resulting
from settlement; and

4. The City of Ames shall replace at its cost any
landscaping, trees, shrubs or ground cover removed by The City of
Ames in the areas comprising the Easements, and shall maintain
and replace again if necessary at its cost any landscaping,
trees, shrubs or ground cover installed or replaced by The City
of Ames for a period of six (6) months following their
installation.

known, who, being by me duly sworn did say that they are the
President and National Secretary, respectively of said membership
organization; ( '
(the seal affixed hereto is the seal of the said
membership organization) . That said instrument was signed on
behalf of said corporation by authority of its Board of
Directors, and that said Raymond A. Olson and Devon R. Woodland
as such officers; acknowledged the execution of said instrument
to be the voluntary act and deed of said instrument to be the
voluntary act and deed of said membership organization, by it and
by them voluntarily executed.
